The Shanghai Labor Bureau has imposed stricter regulations according to the Rules on Foreigners’ Employment Affairs, article 27. The new regulation requires every foreigner working in Shanghai to complete an annual inspection of their Alien Employment Permit.
- This only applies to work permits that are valid for more than one year.
- The application can be submitted within 30 days prior to the expiration date. The expiration date is exactly one year after the issue date or one year after the last annual inspection date.
- Failing to comply with this regulation within three months after the expiration date will result in the cancellation of the Employment Permit.
- Re-applying for an Employment Permit will take 15 working days from submission. During this time, and before the approval is granted, the foreigner is not allowed to work. A re-application may also affect the future annual audit or a permanent permit application.
Crown will continue to track its clients’ records and provide timely alerts to ensure inspections are completed.
