The Indian government recently announced that the Residential Permit/Registration Certificate issued by the Foreigner’s Registration Office (FRO) will include a new endorsement, stating foreigners holding a short-term (six months or less) employment visa must submit a No Objection Certificate (NOC) from the Indian Income Tax Department before leaving India.

Under the new policy, all foreigners are required to attend the FRO office to lodge the NOC (Form 30B) application and request clearance for the endorsement before leaving India. Failure to do so will result in rejection from leaving India.

Changes to private landlords in Gurgaon

Effective immediately, the regulation for reporting the presence of a foreigner has been extended to private landlords in Gurgaon. The Bureau of Immigration has launched an online portal for landlords to register and complete “Form C” within 24 hours of the foreigner's signature on a lease agreement. Once a copy of the form has been generated online, it must be submitted to the FRO office in Gurgaon at the time of registration and/or visa extensions. Previously, a copy of the lease agreement was sufficient.

Points to note:

  1. Any foreigner in India on a short-term work permit should note the above new requirement prior to leaving India.
  2. Foreigners living in private rental accommodation should note the new provision and ensure that their landlords comply with the requirement to file a “Form C” online as soon as the rental agreement is signed.

  4. The new regulations affect Gurgaon only. However, similar changes may also be implemented at other Foreigner Regional Registration Offices (FRROs)/FRO in the coming days. Crown will monitor the development and provide updates when available.
