New regulations consolidate rules implemented over the past year from the Migration Directorate.Significant changes include:
- A requirement to file a new residence permit if the foreigner moves to a new location within Turkey (not covered by the previous permit)
- Eased ban rules once a fine is paid in the case of an overstay
- Invalidation of the visa if not used 180 days after issuance
The consolidated regulations are already in force, but application delays are expected as many immigration officers will not be aware of the changes. Nevertheless, please note the following:
- Visas will become invalid if they’re not used within six months upon issuance.
- Amendments to residence permits should be reported within 20 working days of the change (previous legal timeframe was ten business days).
- New residence permit requirements for foreigners who move to a new city (previously only address notification sufficed).
- Foreign parents can file for a residence permit within 180 days of their child’s birth (instead of a 30-day period). Children departing from Turkey before the issuance of a residence permit will not be banned from entry, but subject to a penalty.
- nternational transferees have ten days from the expiration/cancellation of their work permit to file a new residence permit application (not considered as an over-stay). All foreigners (with a exception of those under Work Authorization) have ten days to apply for the amendment of their status (not for renewals).
- Over stayers who paid a fine will not be banned from future entry to Turkey.
The consolidated changes should be beneficial for foreigners, but certain new requirements will require additional administrative efforts.
